TestPilot OÜ (hereinafter "TestPilot", "we" or "us") recognizes and respects the protection of your fundamental rights and freedoms, and in particular your right to privacy with respect to the processing of your personal data.

You as a user and visitor of the Website ("User" or "you") shall read the Privacy Policy carefully before using the Website.

We have adopted this Privacy Policy to outline all issues with regard to any operation or set of operations which is performed upon any information relating to an identified or identifiable User where an identifiable User is one who can be identified, directly or indirectly, in particular by reference to an identification number or to one or more factors specific to his physical, physiological, mental, economic, cultural or social identity (hereinafter the "Personal Data"), whether or not by automatic means, such as collection, recording, organization, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, blocking, erasure or destruction (hereinafter the "Processing") of your Personal Data at TestPilot's website: https://testpilot.co (hereinafter the "Website").

By using the Website you give us unambiguously an explicit consent to the Processing of your Personal Data.

If you do not read or if you do not agree with some provisions of the Privacy Policy, you shall not use the Website.

1. PROCESSING OF PERSONAL DATA

1.1. All Personal Data which you provide to us via the Website or otherwise are processed in accordance with the provisions of (1) the Personal Data Protection Act of the Republic of Estonia, (2) Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the Processing of Personal Data and on the free movement of such data, starting on May 25, 2018, (3) the General Data Protection Regulation (Regulation (EU) 2016/679) and/or (4) amended or replaced legislation.

1.2. The User may use the Website without any Personal Data to be processed by us. The User may send individual business orders with his/her Personal Data. In this case, the User shall provide certain actual, complete, and accurate information about himself/herself. Third parties may require the User to provide additional data through the website for providing their services.

1.3. TestPilot may collect Personal Data of the User in a variety of ways, including, but not limited to, when the User visits the Website, registers on the Website, fills out any form, sends documents and in connection with other activities, services, features or resources we make available on the Website.

1.4. TestPilot may process the User's Personal Data for the following purposes: to run and operate Website; to respond to inquiries, questions, and/or other requests; to provide Personal Data and copy of documents to the third parties; to facilitate the process of arranging in person or online a meeting with the User; to provide any activities, services, features or resources we make available on the Website; to ensure the security of our network and services; for statistical purposes; and in cases provided by law.

1.5. The User's Personal Data may include: name, surname, middle name, age, gender, e-mail, date of birth, street address, city, state/province, post/zip code, country, telephone number, personal portfolio URL, information related to insurance and payment details, including but not limited to payment card number, security code, expiration date, cardholder name and billing address.

1.6. The User may request a destruction of Personal Data. In this case TestPilot checks whether this request has been done by the User. The check shall be performed within reasonable time. TestPilot may retain some part of the Personal Data in accordance with the applicable law.

1.7. The User may find advertising or other content on the Website that direct to other websites and services. We do not control the content or links that appear at these websites and services and we are not responsible for the Processing of your Personal Data on those websites and services directed from the Website. Those websites and services may have their own privacy policies and terms of use/terms of service/terms and conditions.

2. SECURITY

2.1. TestPilot adopts appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of the Personal Data stored on the Website.

2.2. The User is responsible for maintaining the security of their data. The User agrees to notify TestPilot immediately of any breach of security known with respect to the Website.

2.3. TestPilot is not responsible and do not have control over any third-party website or service that you authorize to access the Website. If the User is using a third-party website or service and the User allows them to access the Website the User does so at their own risk.

3. COOKIES AND OTHER DATA

3.1. TestPilot uses cookies to allow you to be recognized as the User across the Website and to allow your choices to be remembered. Cookies will make sure you are recognized when you return to the Website.

3.2. The Website uses the following types of cookies:

  • - technical cookies to show you the Website, to make it function correctly, to send your business orders;
  • - functional cookies to remember your preferences and to help you to use the Website efficiently and effectively;
  • - analytics cookies to gain insight into how you use the Website, to find out what works and what doesn't, to optimize and improve the Website and to ensure we continue to be interesting and relevant;
  • - commercial cookies to display personalized advertisements on the Website.

3.3. TestPilot may collect data about the User whenever he/she interacts with the Website. These data may include the browser name, the type of computer and technical information about User's means of connection to the Website, such as the operating system and Internet service provider and other relevant data.

3.4. The User may refuse cookies in his/her browser. In this case, some of our features or services may not function properly as a result. We are not responsible for this non-functionality.

3.5. TestPilot may use third-party analytics tools to help to measure traffic and usage trends for the Website. These tools collect information sent by your device including the web pages you visit, add-ons, and other information that assists TestPilot in improving the Website. TestPilot may collect and use this analytics information with analytics information from other users/visitors so that it cannot reasonably be used to identify any particular user/visitor.

3.6. Log file information may be automatically reported by your device each time you make a request to access the Website. It can also be provided when the content of the Website is downloaded to your device.

3.7. TestPilot's servers may automatically record certain log file information, including your web requests, Internet Protocol address, browser type, referring / exit pages and URLs, a number of clicks and how you interact with links on the Website. This information allows for more accurate reporting and improvement of the Website.

4. MISCELLANEOUS

4.1. Should the User breach any of the terms of the Privacy Policy or the Terms of Use, the User is deemed to renounce irrevocably to any protection under the present Privacy Policy and Terms of Use.

4.2. The governing law of the Privacy Policy shall be the law of Estonia.

4.3. Any dispute arising out of or in connection with the Privacy Policy, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by the Courts of Estonia.

4.4. At our sole discretion, TestPilot may change the Privacy Policy at any time. If the User continues to use the Website it means that the User agrees to the updated Privacy Policy. TestPilot will notify about such a change in accordance with the procedure set in the Terms of Use.
